An Overview of the Bail Bond Process
A bail hearing occurs within 48 hours after the arrest of the defendant. During the initial court hearing, a judge sets the bail amount based on a number of factors, such as the nature and severity of the crime allegedly committed by the arrestee.
Once the judge provides the bail amount, the defendant has the option to make an upfront payment if he/she has the funds to do so. Alternatively, the accused can approach a bail bond service provider if he/she is unable to pay the amount in full. The arrestee is required to pay a portion of the bail amount (15 percent) to the bail bondsperson. Once the amount is paid, the bail bond company posts the defendant’s bail in full. The defendant can then get out of jail.
The defendant should take this opportunity to prepare for the next court hearing. If he or she fails to (or chooses not to) appear on the scheduled date, the court will issue a warrant of arrest and require the accused to pay the full bail amount.
