Start With What You Know

What Information Should I Have Ready?

You do not need every detail before asking for help. Start with the information you have.

Start With:

  • Defendant's full legal name
  • Date of birth
  • Current custody location, if known
  • Your contact information

Helpful If Available:

  • Bond amount
  • Bond type
  • Charges

If bond information is not available yet, that does not necessarily mean something is wrong. The person may still be going through processing or waiting for release conditions to be determined.

What Happens Next

How Does the Raleigh Bail Bond Process Work?

The exact circumstances depend on the case, but the process generally follows these stages.

Step 1

Booking and Release Conditions

After an arrest, the person goes through booking and processing. A judicial official determines the conditions of pretrial release. Those conditions do not always include a secured bond. North Carolina law provides several possible forms of pretrial release, depending on the case.

Step 2

Check Whether a Secured Bond Has Been Set

If a secured bond is required, confirm the available bond information. If you do not have everything yet, start with the person's full name, date of birth, and custody information.

Step 3

Contact a Bail Agent, If a Bail Bond Can Be Used

When a secured bond has been set and a bail bondsman can be used, an agent can review the available information and explain what is needed to apply for the bond. Paperwork can often be started by phone or completed electronically, depending on the situation.

Step 4

Review the Bond Requirements

Before anything is signed, the agent should explain the premium, payment requirements, collateral if applicable, and the responsibilities of the person signing the bond agreement. Once the application is approved and the requirements are completed, the bail bond can be posted.

Step 5

The Detention Facility Handles Release

Posting the bond starts the release process. It does not mean the person will walk out immediately. The detention facility completes its own release procedures and determines the order and timing of release.

Who handles what

A judicial official determines the release conditions. Amistad handles the bail bond. The detention facility controls the release process.

No Bond Amount Yet?

What If I Don't Know the Bond Amount Yet?

You can still take the first steps. Start by confirming the person's custody information and gathering their full legal name and date of birth.

If release conditions have not appeared yet, check again as processing continues. You do not need to guess the bond amount or assume that every arrest will require a secured bond.

After the Bond Is Posted

How Long Does Release Take?

No guaranteed time

There is no guaranteed release time after a bond is posted. The detention facility must complete its own release procedures. Another hold, warrant, or separate requirement may also prevent the person from leaving after one bond has been posted.

Amistad can answer questions about the bail bond it handled, but it cannot control the detention facility's release order or exact timing.

Know Who Handles What

Who Is Responsible for Each Part?

A judicial official determines the conditions of pretrial release. Amistad can handle an eligible bail bond when one can be used. The detention facility handles custody and the release process.

Amistad cannot reduce the bond amount, change court-ordered release conditions, remove another hold, provide legal advice, or guarantee when someone will be released.
